Please read these Terms of Service ("Terms," "Terms of Service") carefully before using the Stronghold Assessment website and services (the "Service") operated by Dr. Hines Inc. ("us," "we," "our," or "Company").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

1. Description of Service

Stronghold Assessment provides online personality, attachment style, emotional intelligence, and relationship assessments, along with educational content and resources. The Service generates personalized reports based on your assessment responses.

IMPORTANT NOTICE: The Stronghold Assessment is an educational and self-awareness tool. It is NOT a medical device, psychological evaluation, clinical diagnosis, or substitute for professional mental health treatment. See Section 7 for complete disclaimers.

2. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into these Terms
  • You are not prohibited from using the Service under any applicable law
  • You will comply with these Terms and all applicable laws and regulations

3. User Accounts

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account credentials and for any activities or actions under your account. You agree to:

  • Maintain the security of your password and account
  • Immediately notify us of any unauthorized use of your account
  • Not share your account credentials with any third party

We are not liable for any loss or damage arising from your failure to protect your account credentials.

3.3 Account Termination

You may delete your account at any time by contacting us. We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

4. Payment and Billing

4.1 Fees

Certain features of the Service require payment. All fees are listed on our website and are subject to change. You agree to pay all fees associated with your use of the Service.

4.2 Payment Processing

Payments are processed through third-party payment processors. By providing payment information, you authorize us to charge the applicable fees to your payment method.

4.3 Refund Policy

Due to the nature of digital assessment products that are immediately accessible upon purchase, all sales are final and non-refundable unless:

  • A technical error prevented you from accessing your results
  • The Service was materially different from what was described
  • Required by applicable law

Refund requests must be submitted within 14 days of purchase. Contact us at support@strongholdassessment.com for refund inquiries.

5. Intellectual Property

5.1 Our Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Dr. Hines Inc. and its licensors. This includes but is not limited to:

  • Assessment questions and methodology
  • Scoring algorithms and analysis frameworks
  • Report templates and content
  • Website design, graphics, and user interface
  • Trademarks, logos, and brand elements
  • Educational content and articles

The Service is protected by copyright, trademark, and other intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes. This license does not include:

  • Any resale or commercial use of the Service or its contents
  • Any derivative use of the Service or its contents
  • Any downloading or copying of account information for the benefit of another party
  • Any use of data mining, robots, or similar data gathering tools

5.3 Your Assessment Results

You own your personal assessment data and results. You may share your results with others at your discretion. However, you may not use your results to reverse-engineer our assessment methodology or for any commercial purpose.

6. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Attempt to gain unauthorized access to any portion of the Service
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use any robot, spider, or other automated means to access the Service
  • Circumvent any measures we use to prevent or restrict access to the Service
  • Copy, modify, or distribute any content from the Service without our written permission
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Use the Service to harm, harass, or defraud any person
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service
  • Take the assessment on behalf of another person without their knowledge and consent

7. Disclaimers

7.1 NOT MEDICAL OR PSYCHOLOGICAL TREATMENT

THE STRONGHOLD ASSESSMENT IS NOT THERAPY, COUNSELING, PSYCHIATRIC CARE, OR ANY FORM OF MEDICAL OR MENTAL HEALTH TREATMENT. The Service is an educational tool designed to promote self-awareness and personal development. It does not diagnose, treat, cure, or prevent any mental health condition, disease, or illness.

7.2 NOT A SUBSTITUTE FOR PROFESSIONAL HELP

THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL, PSYCHOLOGICAL, OR PSYCHIATRIC ADVICE, DIAGNOSIS, OR TREATMENT. If you are experiencing mental health issues, relationship crises, or emotional distress, please seek help from a qualified healthcare professional, licensed therapist, or counselor. If you are in crisis, please contact emergency services (911) or the National Suicide Prevention Lifeline (988).

7.3 No Guarantees

We do not guarantee that the Service will meet your specific needs or expectations, that your use of the Service will be uninterrupted or error-free, or that the results you receive will be accurate, complete, or beneficial. Assessment results are based on your self-reported answers and reflect patterns in your responses, not objective measurements of your personality or relationships.

7.4 "As Is" and "As Available"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

7.5 Third-Party Links

The Service may contain links to third-party websites or resources. We are not responsible for the content, products, or services of any third-party sites and do not endorse them.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DR. HINES INC., ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from your use of or inability to use the Service
  • Damages resulting from any decisions or actions you take based on the Service
  • Damages resulting from unauthorized access to or use of our servers or any personal information
  • Damages resulting from any third-party content or conduct

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

9. Indemnification

You agree to defend, indemnify, and hold harmless Dr. Hines Inc. and its officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of the Service
  • Your violation of any rights of a third party
  • Any content you submit or share through the Service
  • Any claim that your use of the Service caused damage to a third party

10. Dispute Resolution

10.1 Informal Resolution

Before filing any formal legal action, you agree to first contact us and attempt to resolve any dispute informally by sending a written notice describing the dispute to our contact address. We will attempt to resolve the dispute through good-faith negotiations for at least 30 days.

10.2 Binding Arbitration

If informal resolution is unsuccessful, any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Tulsa County, Oklahoma, and judgment on the arbitration award may be entered in any court having jurisdiction.

10.3 Class Action Waiver

YOU AND DR. HINES INC. AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

10.4 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Tulsa County, Oklahoma.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will provide notice through the Service or by other means. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable. If modification is not possible, the provision shall be severed, and the remaining provisions shall continue in full force and effect.

14. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and Dr. Hines Inc. regarding the Service and supersede all prior agreements and understandings.
